What the law requires

SIPSI declaration

A prior posting declaration must be submitted via the SIPSI online service before the start of the service.

Representative in France

You must appoint a representative present in France throughout the duration of the service (liaison with the labour inspectorate, retention of documents).

A1 certificate

The A1 form certifies that your employees remain affiliated with the social security scheme of their country of origin.

Documents in French

Payslips, contracts and supporting documents must be kept available, translated into French.

French labour law

Compliance with the "core" rules: minimum wage (SMIC or applicable collective minimum), working time, leave, health and safety.

Construction sector

The BTP card for your posted workers

On construction sites, every building and public works employee must hold the BTP professional identification card — including your posted workers. Without it, the site is exposed to an inspection and a fine.

  • Mandatory for any employee carrying out construction work in France — including posted and temporary workers.
  • The application is made by the employer (or their representative) to CIBTP France, and linked to your posting declaration.
  • Valid for 5 years and active during your posting periods (multi-employer card since 2024).
  • Must be presentable without delay on the site (labour inspectorate, project owner).

We take care of it: as your representative, we apply for and manage the BTP card for each of your posted workers.

Can I handle the formalities myself?

In theory yes, but the SIPSI declaration is made in French, the representative must be present in France, and the documents must be kept and translated there. A mistake or oversight exposes you to a fine per employee. This is exactly what we take care of for you.

How far ahead of the assignment should I get started?

The posting declaration must be made before the start of the service. Ideally, contact us as soon as the assignment is confirmed; we can process declarations quickly, including for imminent assignments.

What if the assignment only lasts a few days?

The obligations apply from the very first day of posting, regardless of the duration. A short assignment must also be subject to a compliant declaration and representation.

Who can be the employer’s representative in France?

A representative present on French territory during the service, mandated by the employer, responsible for liaising with the labour inspectorate and for retaining the documents. Eurofiscalis takes on this role on your behalf.

Do you speak our language?

Does posting to France create other obligations (VAT, establishment)?
