When is a driver posted?

It all depends on the type of operation. Cabotage and cross-trade trigger posting; transit and bilateral transport are exempt.

  • CabotageDomestic transport within another Member State after an international delivery: posting from the very first operation. A maximum of three operations within seven days, then a four-day cooling-off period.
  • Cross-tradeLoading and unloading between two countries other than your country of establishment: posting from the very first journey.

  • TransitCrossing a country without loading or unloading there: no posting.
  • Bilateral transportA journey between your country of establishment and another country, in either direction: no posting.
  • Tolerated activitiesOne loading/unloading activity on the outbound leg and one on the return leg (two on the return if none on the outbound) remain tolerated — provided a smart tachograph is fitted.

What the Mobility Package requires

The formalities to meet for each posted driver — we take care of them in every country.

IMI declaration

The posting declaration, to be filed by the carrier on the European portal before the assignment begins. Valid for up to 6 months and provided to the driver (QR code).

Minimum wage of the destination country

For cabotage and cross-trade, the driver receives the applicable remuneration of the country where they are posted — minimum wage, mandatory premiums and bonuses included.

A1 certificate

Your drivers remain affiliated to the social security system of their home country under cover of the A1 certificate — a document separate from the IMI declaration, to be obtained for each driver.

Documents on board

The driver must be able to present the IMI declaration, the consignment note (CMR / e-CMR) and the tachograph data during a roadside check.

Driving time & rest

The driver must be able to return home every 4 weeks (sometimes ~3); the regular weekly rest cannot be taken in the cab.

Smart tachograph

The smart tachograph V2 is mandatory for international transport; the requirement extends to light commercial vehicles of 2.5 to 3.5 t (1 July 2026, to be confirmed).

Your drivers’ IMI declaration

Posting a driver requires a single declaration in the European IMI system. It is this declaration that grants the right to drive in compliance in the destination country.

  • It is the transport company that files the declaration — not the driver — before the posting begins, on the single European portal.
  • A declaration covers up to 6 months and generates a document (QR code) provided to the driver.
  • Since 2 February 2022, IMI has replaced the national portals: SIPSI (France), MiLoG (Germany), LIMOSA (Belgium)… no longer apply to drivers.
  • Payroll documents do not travel on board: they are transmitted afterwards, at the authority’s request, via the IMI system.

Remuneration by destination country

For cabotage and cross-trade, your driver receives the applicable wage of the country where they are posted. Each country has its own scheme.

Non-exhaustive list. Wage scales are revised regularly (often on 1 January) — we apply each country’s up-to-date amount, rather than fixed figures that would quickly become outdated.

Regulatory update

Return of the vehicle: what has changed

The obligation to bring each vehicle back to its base every 8 weeks was annulled by the Court of Justice of the EU on 4 October 2024, following an action brought notably by Poland. As of 2026, this obligation is no longer in force.

By contrast, the return of the driver every 4 weeks remains fully applicable. As the regulation may evolve (the Commission may legislate again), we monitor this point closely for you.

Frequently asked questions

What is the Mobility Package and who is concerned?

The Mobility Package is the set of European rules governing international road transport: posting of drivers, IMI declaration, driving and rest times, cabotage, access to the profession. It concerns any transport company whose drivers travel beyond their country of establishment.

When is a driver considered posted?

As soon as they perform cabotage (domestic transport within another country) or cross-trade (between two countries other than your country of establishment). In these cases, the IMI declaration and the destination country’s wage apply.

Do bilateral transport and transit have to be declared?

No. Transit (crossing without loading or unloading) and bilateral transport (between your country and another, in either direction) do not trigger posting. One loading/unloading activity on the outbound leg and one on the return remain tolerated, provided a smart tachograph is fitted. We qualify each operation for you.

How do I declare a posting in the IMI system?

The declaration is filed by the transport company on the European portal, before the posting begins. It covers up to 6 months and generates a document to be provided to the driver. We make and renew these declarations on your behalf.

Do SIPSI, MiLoG or LIMOSA still apply to drivers?

No. Since 2 February 2022, the IMI system has been the only authorised portal for the posting of road drivers. The national portals — SIPSI (France), MiLoG (Germany), LIMOSA (Belgium), etc. — must no longer be used for drivers.

What minimum wage must I pay my posted driver?

That of the country where they are posted (for cabotage and cross-trade): minimum wage, mandatory premiums and bonuses of that country. Each country sets its own scale, revised regularly. We apply the up-to-date scale of each destination country.

How long is an IMI declaration valid?

A declaration can cover from one day up to a maximum of 6 months. Beyond that, a new declaration is required. We track the deadlines and carry out the renewals.

Does the obligation to return the vehicle every 8 weeks still exist?

No. The Court of Justice of the EU annulled this obligation on 4 October 2024, following an action brought notably by Poland. As of 2026, the return of the vehicle every 8 weeks is no longer in force. By contrast, the return of the driver every 4 weeks does remain applicable. As the regulation may evolve, we monitor this point closely.

How often must the driver return home?

The company must organise the work to allow the driver to return (to the operational centre or to their home) every 4 weeks — and sooner (around 3 weeks) after two consecutive reduced weekly rests. The regular weekly rest cannot be taken in the cab.

Is the tachograph mandatory on light commercial vehicles of 2.5 to 3.5 t?

The smart tachograph requirement extends to light commercial vehicles of 2.5 to 3.5 tonnes used in international transport (deadline announced for 1 July 2026, to be confirmed). These vehicles are also subject to access to the profession and to the Community licence.

What penalties apply in the event of non-compliance?

Depending on the country carrying out the check: fines (missing IMI declaration, underpayment of the minimum wage, non-compliant tachograph), immobilisation of the vehicle, and possible damage to the company’s good repute and to its Community licence. Checks are coordinated at European level.

Do my drivers keep their home social security (A1 certificate)?

Yes, under cover of the A1 certificate, which attests that they remain affiliated to the social security system of their home country. It is a document separate from the IMI declaration: the A1 falls under social security, IMI under labour law. Both may be required at the same time — we check your situation.

How does the collaboration work in practice?

You send us your data (drivers, tachograph data and driver cards, consignment notes, schedules) via your client area. Each month, we produce your IMI declarations, the calculation of the minimum wage due by country, the working time record and the documents ready for inspection. You track everything from the platform.

Do you also step in during an inspection or a problem on the road?

Yes. Beyond declarations, we respond to inspections via the IMI system and, thanks to our network of offices and partners across Europe, we assist you when the unexpected happens: a fine, immobilisation of the vehicle, an accident, damage or a disputed toll — with a contact who speaks your language and that of the country.

Do I need a representative in each destination country?
