The ‘Loi Macron’ entered into force on 1 July 2016, which means that European transportation companies that plan to delegate drivers to France are obliged to appoint a representative: Decree No 2016/418. Employers are obliged to fill in the secondment declaration, called SIPSI, on the official website of the Ministry of Labour www.sipsi.travail.gouv.fr.

The agreement with Eurofiscalis is signed for a period of 6 months and will be automatically extended by another half year if the client does not submit their resignation. You may resign from the agreement one month before the date of its termination on the Eurofiscalis website or by sending a termination notice by registered mail with acknowledgement of receipt.
The representative in France acts on behalf of a client and contacts the labour inspection authority, the police, gendarmerie, and tax and customs offices in the event of an inspection. He or she also takes responsibility for storing documents which should be presented at the request of inspection authorities.
Transportation companies which plan to temporarily second vehicle drivers to France on one or several routes must prepare in advance a secondment declaration, commonly referred to as SIPSI. A declaration drawn up in French should be filled in and sent prior to the first secondment. A SIPSI declaration must be sent through the official website of the French Ministry of Labour. The certificate is valid within the period indicated by the company, but no more than 6 months from the date on which it was drawn up. During the course of the declaration’s validity, you may second workers several times.
